so I tried this, works great but after a day or 2 the wax paper start to drp up away from the paper towel which is underneath it even though it is very wet at the bottom, any tips? maybe I'm just over using it?

How much you use it doesn't matter much, as far as drying is concerned. You should be using "parchment" paper...not wax paper...HUGE difference, so if you are using wax paper, switch that out for some parchment...problem solved. If you are using parchment, the paper towel needs to be like dripping wet (not just wet to the touch), if you have a little puddle around it (but not enough that the parchment is in the puddle too) then that is ideal. Um...also you don't want a very thick layer of paper towels, just a couple layers of sheets, not sure on your exact set up but if it's too thick it loses the "wicking" ability. The buckling in parchment paper is just something you have to live with, it works out well in some ways, gives you nice little pockets to store paint in. Fine mist spray bottle helps keep the edges and raised bits moist.

Sorry, I am using parchment paper, I think I might know what's affecting it, last couple days I had air conditioner on (mobile) so the room is pretty cool but dry at same time, and I did use it about 4-5 hours a day, so that might be affecting it too, regardless this is great, much better than any dry art pallets I have used before. :D

Oh, yeah, that'd do it, any air flow will probably be too much in the longer term. I'd try the spray bottle next time. I love my wet palette too. G'luck.
