TRF published basically what happens:
the rule you reffer to was that if you were to shoot out the of hatch then the vehiculeis to be considered open topped for purposes of the vehicule taking fire in the subsequent turn only. It dates back to second ed and was held over into third. That is why it refferences the armour of the guys inside because at one time non marines could have marine tanks regularily like speeders for example and so they needed to represent the weaker riders in the defence characteristic of the vehicule. So yeah the vehicule will only count as open topped for the negative aspects of the clasification and not any of the positives.
Again I understand the intent but i am not able to find any current rules that actually support this, the only rule i see is the one in the Codex that:
1. Does not indicate that this is meant only regarding shooting,
2. Does not indicate how long the vehicle remains "opened topped",
the the most logical option would be that it remains opened topped until the start of my next shooting phase, but this would mean i could disembark from an "opened topped" vehicle in my next movement phase allowing me to charge..
I understand this is rules lawyering and that it would not be a good idea to try and pull it in a game, but i am wondering if someone can point to an actual rule that says this is not the case since codex trumps BRB and seems to leave actual rule quite open ended, I'm sure there is an official ruling, i'm just not sure where it is,
